This week, the Federal Trade Commission issued a little-noticed letter to the Texas Supreme Court that could have a significant impact on the legal profession. The state justices are exploring a radical change in bar admissions, seeking alternatives to the American Bar Association.
In their letter, FTC officials indicated that they view the ABA as an effective monopoly in bar admissions. The potential state change itself may be less important than how the ABA itself has changed in bringing about these growing calls for separation from the roughly 150-year-old organization.
In the fall, the Texas Supreme Court issued a tentative opinion that declared that the ABA “should no longer have the final say on whether a law school’s graduates are eligible to sit for the Texas bar exam and become licensed to practice law.”

Tax form 990 is required for every Non- Profit in America to show a paper a trail for said public finances.

The museum they opened in 2010 on shore is great if you get the chance to go. The museum is part of the tour out to see the Arizona. You are only allowed 15 minutes in the Arizona Memorial and the navy is strict about that so if you want to really want to see it all plan on 2 or 3 visits. The museum you can stay at all day once inside. Was worth every penny it cost us to go see it.

Most of that generation is now passed on or in “retirement”, but the rest of us shouldn’t let the world forget.
My Dad was younger, but drafted towards the end of the war. He served his whole enlistment stateside. He was charged with making sure Army recruits were “water safe”, i.e., they wouldn’t drown getting off of landing craft at the beach, parachuting into a pond, etc. He spent most of his day taking recruits (some “terrified” of heights and water) off the three meter platform. One after the other, climb the three meter ladder and off with the next guy. Some of those scared sh1tless dudes were “huge and a handful”. Dad talked about this experience exactly one time. In a car as I drove Mom and Dad by Fort Ord on the way to visit the newly opened Monterey Aquarium. I watched my Mom’s face in the back seat via the rearview mirror. She was astonished by what she heard – he’d never shared any of it before. People he didn’t know from his home town (a college town where his father taught and led a department) that knew his family befriended him and helped him find that role. He was an excellent swimmer and fearless in the water. He served his time and moved on to civilian life, raising a family in relative obscurity. He was a happy guy, married to a wife that was devoted to him.
What a lucky man you are to have had a dad like that!

Just poured my first cup! Stressful times going on here- my Dadi is in the hospital, but that presents an issue with his dementia. My hubs or I are always with him, but he’s starting to get cranky and confused with his routine disrupted. At 98, he has never really been ill or spent time in a hospital so we have our hands full thankful, tho, for caring nurses and aides. So ….bring on the coffee!

God bless him! 98? I tell my 96YO Mom that she gets to have whatever preference she wants – she worries that she might offend someone or be judged badly. I tell her, “Not a chance, at 96 you get a free pass on all of that”. To which, she giggles and laughs, thanking me for saying so. Recently, Mom shared that she hates her daily vitamins. She didn’t want anyone to know that she secretly discarded them everyday. She has been doing it for months and just told me, sharing that it felt like a huge act of delicious rebellion. I was rolling on the floor laughing! She swore me to secrecy… ‘-)
Without “giving her up”, I had my sibling replace the offending vitamins with something different. Mom reported that she has a new vitamin that she likes, but will now miss her “little, daily act of rebellion”, too. God love her… if you are in your 90s… do what makes you happy! We all love you anyway.

In honor of my 2 uncles that were on Hickam Field Army Air Base in Pearl Harbor the day the Japanese attacked. They both survived the war and told me all about that day and the days that followed.
Thank you, Thunderbird! God bless your uncles – how lucky for you to have the first hand stories of their experiences. Here we are at Dec. 7.

My granpa told hundreds of WW2 stories, later in life he would start one and trail off then pick up another one then finish the first one.
My grandpa was in the corps of engineers and helped build the facilities where the Manhattan Project explosive materials were developed in Missouri. The dept. of energy has a museum at the site in Weldon Spring and has old photos displayed that include him in them. His two youngest brothers were my great uncles at Pearl Harbor that day. My grandpa was one of seventeen children, sixteen boys and one girl. Fourteen of the boys served in the military during the war. This is only part of the family, as my mother came from a very large family also so as a kid that loved history I had 26 family members that served in the war in some capacity. Most but not all would talk to me about it. I miss so many of thoes fine men and many of the great women they married. I had a great childhood so very lucky and so very grateful.

Merriam and other critics are correct to observe that originalism does not advance a “new constitutional morality.” It does not promote “good” or “bad” outcomes—it simply enforces the constitutional rights and structures established in the constitutional text as understood by those who ratified it.
For example, originalism does not ask whether a right to bear arms makes sense in terms of a natural right of self-defense, a social contract theory of government by consent, a traditional state provision of public safety, or a utilitarian calculus weighing the benefits of gun control in reducing violence. It simply asks whether those who ratified the Constitution would have understood the language of the Second Amendment to protect an individual right to possess firearms. In District of Columbia v. Heller (2008) and McDonald v. City of Chicago (2012), Justice Antonin Scalia in the former case and Justice Samuel Alito in the latter one may have looked to natural rights theory, but they did so only to understand the historical context that gives meaning to words such as “the right of the people to keep and bear Arms.”
Calls for a “new constitutional morality” rest on a mistaken view of the courts and their role in constitutional interpretation. When originalism fails to produce the moral outcomes Merriam and other critics prefer, they treat this as a defect in the method. But originalism does not supply a moral philosophy—it is a method of interpretation. It keeps judges within the boundaries of the proper judicial role set out in the Constitution.
Presidents and Congress, no less than governors and state legislators, play the primary role in identifying public morals and implementing them through statutes, regulations, and executive orders. As Alexander Hamilton argued in Federalist 78, the “proper and peculiar province of the courts” is “the interpretation of the laws,” not pronouncing or enforcing a specific morality. Judicial review arises only because a court, confronted by “an irreconcilable variance between” an act of Congress and the Constitution, must enforce the law with “superior obligation and validity,” in other words, the Constitution. As Hamilton concluded, “[T]he constitution ought to be preferred to the statute, the intention of the people to the intention of their agents.”

Originalism seems philosophically neutral on the issue of the Constitution as a moral stance, though the founders certainly had moral stances.
Originalism’s best use seems to be swatting down all the Johnny-come-lately moral philosophies that want to re-interpret the Constitution to reflect some current fad of moral perfection.
It would appear that our Founders had this in mind by leaving morality to religion rather than including it in the Constitution. Their separation of church (morality codes) from state would seem to confirm originalism.
Just my thought, as I’m neither a lawyer nor a moral philosopher.
